Calmian is a wellness companion app operated by İsmail Selçuk May, İstanbul, Türkiye ('Calmian', 'we', 'us'). These Terms apply whenever you use the app, including Talk It Out conversations, My Voice, journaling, mood tracking, breathing exercises and reminders. By creating an account or using the app you accept these Terms together with our Privacy Policy and Data Usage Policy, which explain how your data is handled.

Calmian is not a medical device, a therapist, a counselor or a clinical service. It does not diagnose, treat or prevent any condition and is not a substitute for professional medical or mental health care. Always seek the advice of a qualified professional with any questions about a medical or mental health condition, and never delay or stop care because of something you read or heard in the app.

Conversations in Calmian are generated by artificial intelligence, not by a human. Voice and text conversations are processed by OpenAI, and My Voice replies are spoken by our own speech server. AI responses can be wrong, incomplete or inappropriate, and they are not medical advice. Do not rely on Calmian alone for important decisions about your health or wellbeing.

Calmian is not an emergency service and is not monitored by people. If you are in immediate danger or thinking about harming yourself, contact your local emergency services or a crisis line right away. The app shows crisis numbers for the country it believes you are in, based on your device region or, if you allow it, your approximate location. These numbers may not always be current or reachable where you are. The app also checks what you say for signs of crisis so it can point you to help; this is an automated safeguard and can miss things.

You must be at least 18 years old to use Calmian. The app is for adults only and is not directed at anyone under 18; if we learn that a person under 18 has an account, we will close it. You must provide accurate account information, keep your sign-in details safe, and you are responsible for everything that happens under your account.

Everything you write, say or record in Calmian remains yours. You allow us to process it only as needed to run the service, as described in the Privacy Policy. Do not store other people's private information in Calmian without their consent, and do not upload or say anything unlawful, abusive or harmful.

My Voice creates a synthetic copy of a voice from a recording you make in the app. You may only record your own voice, or the voice of an adult who has given you clear permission and understands that a synthetic copy will be created. You must not clone anyone else's voice, impersonate a person, or use a synthetic voice to deceive, harass or defraud anyone. You can delete your voice at any time in My Voice, and deleting your account removes it as well.

My Voice sessions are booked in one-hour time slots and paid with session packs. Each session allows up to 40 minutes of conversation. One session is deducted from your balance when a booked slot ends, including if you do not attend, unless you cancel or reschedule at least 15 minutes before the start. A single free 3-minute My Voice trial is available once per account, when the speech server is free. Sessions depend on third-party infrastructure, so we cannot guarantee that every slot will be available.

Purchases are made through Apple's App Store and are subject to Apple's terms. Prices are shown in the App Store before you buy. Talk It Out subscriptions (weekly, monthly or annual) include a fixed number of voice minutes per period — 30 a week, or 120 a month — used only by spoken calls; typed conversations are included without a minute limit. Minutes that are not used by the end of a period do not carry over, and a single call is limited to 30 minutes. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends; you can manage or cancel them in your Apple ID settings. A single free 3-minute spoken trial is available once per account before subscribing. My Voice session packs are consumable purchases, and unused sessions have no cash value. Refunds are handled by Apple under its refund policy, except where the law gives you additional rights. We never see or store your payment details.

Do not misuse the app: do not try to break its security, interfere with other users, reverse engineer it, access it with automated tools, or use it for anything illegal. We may suspend or close accounts that break these Terms or put other people at risk.

The Calmian app, its design, exercises, texts and software belong to us or our licensors and are protected by copyright and other laws. We grant you a personal, non-transferable right to use the app for your own wellbeing. We may change, suspend or discontinue features at any time.

Calmian is provided 'as is' and 'as available'. To the fullest extent permitted by law, we make no warranties about the accuracy, reliability or availability of the app or its AI responses, and we are not liable for decisions you make based on it, for loss of data, or for indirect or consequential damages. Nothing in these Terms limits liability that cannot be limited by law, including for gross negligence or intentional misconduct.

You can stop using Calmian at any time and delete your account from Profile. We may end or suspend your access if you break these Terms. Sections that by their nature should survive, such as your content rights and our disclaimers, continue after termination.

We may update these Terms from time to time. The date at the top shows the latest version, and we will tell you in the app about significant changes. Continued use after a change means you accept the updated Terms.
